{"id":11949,"date":"2017-09-02T16:48:32","date_gmt":"2017-09-02T14:48:32","guid":{"rendered":"https:\/\/www.geciclaw.com\/?p=11949\/"},"modified":"2025-12-22T15:02:30","modified_gmt":"2025-12-22T14:02:30","slug":"pks-predlaze-potpuni-preobrazaj-srpskog-prava-konkurencije","status":"publish","type":"post","link":"https:\/\/www.geciclaw.com\/sr\/pks-predlaze-potpuni-preobrazaj-srpskog-prava-konkurencije\/","title":{"rendered":"Privredna komora Srbije predla\u017ee potpuni preobra\u017eaj srpskog prava konkurencije?"},"content":{"rendered":"<h4>Skora\u0161nji razvoj doga\u0111aja u Srbiji, a naro\u010dito neuobi\u010dajeno veliki broj naprasno pokrenutih postupaka od strane <a href=\"http:\/\/www.kzk.org.rs\/\">Komisije za za\u0161titu konkurencije<\/a>, kao i najava potpune promene zakona o za\u0161titi konkurencije, koji su bili predmet nedavno objavljenog \u010dlanka \u201e<a href=\"https:\/\/www.geciclaw.com\/sr\/nenajavljeni-uvidjaji-republika-srbija-pravo-konkurencije\/\"><em>Nenajavljeni uvi\u0111aji \u2013 po\u010detak za\u0161tite konkurencije ili kraj vladavine prava u Srbiji?<\/em><\/a>\u201c izazvali su zabrinutost mnogih, kao i\u00a0 sna\u017eno negodovanje javnog i privatnog sektora. Zanimljiv obrt u naporima da se reformi\u0161e sistem se desio 21. avgusta 2017. godine kada je <a href=\"http:\/\/www.pks.rs\/\">Privredna komora Srbije<\/a> (u daljem tekstu: Privredna komora) uputila poziv za konsultacije sa \u010dlanovima Skup\u0161tine i Upravnog odbora o primeni i najavljenim izmenama Zakona o za\u0161titi konkurencije (u daljem tekstu: Zakon). Privredna komora je posebno ukazala na austrijski model koji \u201epredvi\u0111a jasnu podelu nadle\u017enosti izme\u0111u uprave i sudstva\u201c.<\/h4>\n<p><strong>\u0160iroko nezadovoljstvo<\/strong> <strong>javnog<\/strong> i <strong>privatnog<\/strong> <strong>sektora<\/strong> tokom proteklih meseci doseglo je potpuno novi nivo kada je Privredna komora objavila <strong>poziv za konsultacije<\/strong> o primeni Zakona. Privredna komora je ukazala na \u010dinjenicu da je primena Zakona, o kojoj \u0107e biti re\u010di u nastavku, pokazala da postoji prostor za normativna unapre\u0111enja i pozvala svoje \u010dlanove da u\u010destvuju u formiranju stava privrede o ovom pitanju. Va\u017eno je napomenuti da \u010dlanstvo Privredne komore uklju\u010duje najeminentnije predstavnike privrede kako na\u00a0 regionalnom, tako i na internacionalnom nivou.<\/p>\n<p>Iako o\u010dekivan, poziv Privredne komore predstavlja zna\u010dajnu prekretnicu, jer pokazuje da je negodovanje me\u0111u poslovnim liderima preraslo u \u0161iru koaliciju istomi\u0161ljenika. Tako\u0111e, poziv je upu\u0107en kao reakcija na agresivno kori\u0161\u0107enje ovla\u0161\u0107enja Komisije za za\u0161titu konkurencije Srbije (u daljem tekstu: Komisija) da <u>sprovede nenajavljene uvi\u0111aje<\/u> i <u>naprasno pokrene<\/u> neuobi\u010dajeno veliki broj <u>postupaka<\/u>, pri tome odr\u017eavaju\u0107i <u>pragove za kontrolu koncentracija na neuobi\u010dajeno niskom nivou <\/u>(<a href=\"https:\/\/www.geciclaw.com\/sr\/nenajavljeni-uvidjaji-republika-srbija-pravo-konkurencije\/\">link<\/a>).<\/p>\n<p>Postupci Komisije su eskalirali nedavnim objavama o dono\u0161enju novog zakona \u010diji je cilj jo\u0161 efikasnije sprovo\u0111enje izvr\u0161nih ovla\u0161\u0107enja ovog organa. Ovaj potez, kao i pokretanje postupaka tokom maja 2017. godine, potencijalno ukazuju na nameru da se <strong>izigraju \/ anuliraju<\/strong> odre\u0111ene odredbe Zakona o op\u0161tem upravnom postupku (Novi ZUP), \u0161to bi moglo <strong>dovesti do onemogu\u0107avanja razvoja pravi\u010dnog postupanja u predmetima za\u0161tite prava konkurencije u Srbiji kao potpisnici <a href=\"http:\/\/www.echr.coe.int\/Documents\/Convention_BOS.pdf\">EKLJP<\/a><\/strong>. Iako je uobi\u010dajeno za Privrednu komoru da u\u010destvuje u procesu dono\u0161enja zakona, negodovanje poslovnog sektora je uticalo na Privrednu komoru da se u ime zainteresovanih aktera iz javnog i privatnog sektora uklju\u010di u ovaj postupak u mnogo ranijoj fazi.<\/p>\n<p>Privredna komora je u svom pozivu za konsultacije istakla da za razliku od SAD i mnogih evropskih sistema koji obezbe\u0111uju <strong>visoke proceduralne garantije<\/strong> i <strong>aktivno sudsko anga\u017eovanje<\/strong> i <strong>kontrolu<\/strong> tokom celog postupka, va\u017ee\u0107i <strong>srpski<\/strong> <strong>Zakon<\/strong> <strong>ne nudi ni jedno ni drugo<\/strong>. Konkretno, Zakon propisuje izuzetno \u0161iroka<strong> ovla\u0161\u0107enja<\/strong>, uklju\u010duju\u0107i i ovla\u0161\u0107enje za izricanje <strong>najve\u0107ih nov\u010danih kazni<\/strong>, kojima Komisija raspola\u017ee u svojstvu upravnog organa. Osim toga, iako nenajavljeni uvi\u0111aji predstavljaju sredstvo koje koriste nadle\u017eni organi za za\u0161titu konkurencije \u0161irom sveta, u Srbiji se isti mogu sprovoditi bez ikakvog neposrednog sudskog nadzora (ex ante ili ex post), a odnosna stranka je o uvi\u0111aju obave\u0161tena tek u trenutku sprovo\u0111enja istog. Tako\u0111e, poziv Privredne komore ukazuje i na pitanja procesne prirode.<\/p>\n<p>Prema na\u0161em mi\u0161ljenju, va\u017ee\u0107i zakon omogu\u0107ava Komisiji da vodi postupke <strong>bez po\u0161tovanja osnovnih procesnih garancija, usmene rasprave<\/strong> i <strong>sudske kontrole<\/strong>, istovremeno izri\u010du\u0107i <strong>kazne<\/strong> u visini <strong>do 10% godi\u0161njeg prihoda<\/strong> (zapravo <u>najve\u0107i iznos nov\u010dane kazne poznat srpskom pravnom sistemu<\/u>).<\/p>\n<p>Jo\u0161 jedan faktor koji je mogao izazvati reakciju Privredne komore jeste \u010dinjenica da je aktuelno rukovodstvo <strong>Komisije<\/strong>, za razliku od njegovih opreznijih prethodnika, odlu\u010dilo da <strong>\u0161iroko postavljena ovla\u0161\u0107enja i apsolutnu slobodu odlu\u010divanja <\/strong>iskoristi na iznena\u0111uju\u0107e agresivan na\u010din. Navedena\u00a0tvrdnja proizilazi iz \u010dinjenice da je Komisija pove\u0107ala svoje aktivnosti i to ba\u0161 u ovom trenutku, neposredno pred po\u010detak primene dugoo\u010dekivanog Novog ZUP 1. juna 2017. godine. \u0160tavi\u0161e, iako Komisija nije pokazala strah u borbi sa najve\u0107im tr\u017ei\u0161nim igra\u010dima \u2013 istragama su obuhva\u0107eni <em>Banca Intesa, <a href=\"https:\/\/www.pmi.com\/markets\/serbia\/en\">Philip Morris<\/a>, <a href=\"http:\/\/www.bat.com\/group\/sites\/UK__9D9KCY.nsf\/vwPagesWebLive\/DO9FCCCA\">BAT<\/a>, Ferrero, <a href=\"http:\/\/www.frikom.rs\/rs\">Frikom<\/a>, <a href=\"https:\/\/aks.org.rs\/sr_lat\/\">Advokatska komora Srbije<\/a>, EPS Distribucija i mnogi drugi<\/em> &#8211; ovaj nao\u010digled pozitivan razvoj doga\u0111aja propra\u0107en je ozbiljnim kr\u0161enjem procesnih garancija, te\u017enjom ka ispunjenju nejasnih politi\u010dkih ciljeva, kao i sveobuhvatnom arbitrernosti u postupanju, bez sudskog nadzora.<\/p>\n<p>U cilju prikupljanja najboljih primera prakse u primeni odre\u0111enih propisa, Privredna komora je istakla niz predloga i potencijalnih re\u0161enja. Kako je navedeno u pozivu, Privredna komora se fokusirala na <strong>zakonska re\u0161enja<\/strong> iz <strong>Evropske unije<\/strong>, prvenstveno imaju\u0107i u vidu te\u017enju Srbije ka punopravnom \u010dlanstvu u EU. Konkretnije, Privredna komora u pozivu ukazuje na <strong>austrijski model<\/strong>, koji tako\u0111e postoji u \u0160vedskoj, Finskoj, SAD i Kanadi, a koji podrazumeva <strong>jasno razdvajanje istra\u017ene i funkcije odlu\u010divanja<\/strong> u postupcima za\u0161tite konkurencije.<\/p>\n<p>Izbor austrijskog modela je veoma razumljiv s obzirom na sli\u010dnosti izme\u0111u dve dr\u017eave i blisku ekonomsku saradnju njihovih privrednih komora, a koja \u0107e omogu\u0107iti sticanje neophodnog znanja od iskusnog me\u0111unarodnog partnera u primeni ovog modela.\u00a0 \u0160tavi\u0161e, gospodin Marko \u010cade\u017e, predsednik Privredne komore Srbije, nedavno je izjavio da Privredna komora ima za cilj &#8222;<em>da omogu\u0107i austrijskim kompanijama da se u Srbiji ose\u0107aju kao kod ku\u0107e, kao i da im Privredna komora Srbije pru\u017ei pomo\u0107 i usluge koje odgovaraju onima koje dobijaju od austrijskih privrednih komora<\/em>&#8222;(<a href=\"http:\/\/www.diplomacyandcommerce.rs\/marko-cadez-president-of-the-serbian-chamber-of-commerce-friends-and-partners\/\"><em>link<\/em><\/a>).<\/p>\n<p>Kona\u010dno, anga\u017eovanje Privredne komore Srbije jeste poziv \u0161iroj javnosti za preko potrebno u\u010de\u0161\u0107e u otvorenoj raspravi o Zakonu, \u010diji je cilj za\u0161tita procesnih garancija, ljudskih prava i pravne sigurnosti pri poslovanju u Srbiji, \u0161to je najavljeno i u gore navedenom \u010dlanku na ovu temu.
