Me\u0111utim, kako anga\u017eovati influensera za takav posao? Influenseri po pravilu nakon \u201esticanja slave \u201c svakodnevno dobijaju ponude da reklamiraju razne vrste proizvoda i usluga, ali da li je i kako to pravno regulisano u Hrvatskoj?<\/p>\n<p>O tome kakav je njihov polo\u017eaj, pravno gledano, kao i koje obaveze imaju, vi\u0161e u nastavku.<\/p>\n<h2><strong>Kako anga\u017eovati influensera u Hrvatskoj?<\/strong><\/h2>\n<p>Sli\u010dno kao u Srbiji, ne postoji zakon ili podzakonski akt koji bi izri\u010dito regulisao njihov polo\u017eaj.\u00a0\u00a0 Hrvatska je dr\u017eava \u010dlanica EU, a postoji namera\u00a0 da se polo\u017eaj influensera izri\u010dito uredi u okviru EU, te se mo\u017ee o\u010dekivati da \u0107e u narednom periodu biti donet akt koji bi izri\u010dito regulisao polo\u017eaj influensera. To bi svakako bila velika novina, a i vi\u0161estruko zna\u010dajno jer bi otklonilo sve nedoumice koje se postavljaju dok analiziramo polo\u017eaj i poslovanje influensera. Influensing je definitivno zanimanje sada\u0161njosti (i budu\u0107nost), a pravo mora da ide u korak sa tim.<\/p>\n<h2><strong>Za sada se influenser mo\u017ee anga\u017eovati\u2026<\/strong><\/h2>\n<p>Naj\u010de\u0161\u0107e re\u0161enje u praksi je <a href=\"https:\/\/www.geciclaw.com\/sr\/polozaj-influensera-zapadni-balkan-srbija\/\">sli\u010dno<\/a> onom u Srbiji. Naime,\u00a0 sa influenserima se zaklju\u010duje\u00a0 ugovor o delu koji je regulisan <a href=\"https:\/\/www.zakon.hr\/z\/75\/Zakon-o-obveznim-odnosima\">Zakonom o obveznim odnosima<\/a>. Definicija ovog ugovora podrazumeva postojanje izvo\u0111a\u010da koji treba da obavi neki posao, bilo fizi\u010dki ili umni, a naru\u010ditelj ima obavezu da mu za to plati naknadu.\u00a0 S obzirom na veliku \u0161irinu koju ovakva definicija obezbe\u0111uje, jasno je da se influensing mo\u017ee podvesti pod nju, ali ostaje pitanje da li bi bolje re\u0161enje bilo da postoji specifi\u010dan ugovor kojim se regulisao influensing.<\/p>\n<h2><strong>Da li je influensing ogla\u0161avanje?<\/strong><\/h2>\n<p>Mo\u017eemo re\u0107i da Influensing u Hrvatskoj potpada pod pojam ogla\u0161avanja u zakonskom smislu. U tom pogledu, moramo da konsultujemo <a href=\"https:\/\/www.zakon.hr\/z\/38\/Zakon-o-medijima\">Zakon o medijima<\/a>.\u00a0 Kao \u0161to se mo\u017ee pretpostaviti, ovaj zakon se ne bavi izri\u010dito pitanjem dru\u0161tvenim mre\u017ea i influensera kao aktera na istim.\u00a0 Me\u0111utim, ovaj zakon vrlo detaljno reguli\u0161e \u0161ta je to oglas.\u00a0 Dakle, prema Zakonu ogla\u0161avanje se obavlja uz nov\u010danu ili drugu naknadu ili u svrhu samopromocije. Pored toga, jasno se postavlja zahtev da oglas bude ozna\u010den kao takav i vidljivo odvojen od drugih programskih sadr\u017eaja. Koliko je ovo \u201erazdvajanje\u201c u praksi mogu\u0107e kad je re\u010d o influensingu, ostaje kao nedoumica.<\/p>\n<p>Tako\u0111e, zabranjuje se obmanjuju\u0107a praksa povodom ogla\u0161avanja \u2013 naime, oglas ne sme da stvara zabunu da je re\u010d o programskom sadr\u017eaju medija.<\/p>\n<h2><strong>I ne samo to\u2026<\/strong><\/h2>\n<p>Influenseri moraju da vode ra\u010duna o tome da li su pla\u0107eni za oglas, to jest influensing. Ako je oglas besplatan, to mora da se posebno nazna\u010di, a svaka novinarska forma koja je pla\u0107ena, a\u00a0 nije ozna\u010dena kao ogla\u0161avanje se smatra prikrivenim ogla\u0161avanjem.<\/p>\n<p>Kao i u Srbiji, na sponzorisanim sadr\u017eajima mora na neki na\u010din biti navedeno ime ili znak sponzora.<\/p>\n<h2><strong>A ne mo\u017ee ba\u0161 ni da se ogla\u0161ava bilo \u0161ta\u2026<\/strong><\/h2>\n<p>Postoji zabrana ogla\u0161avanja odre\u0111enih proizvoda. To su, izme\u0111u ostalog, duvanski proizvodi, alkoholni proizvodi, oru\u017eje i lekovi koji se izdaju samo na recept.\u00a0 Jasno se zabranjuje i\u00a0 bilo koja vrsta ogla\u0161avanja koja bi bila usmerena ka diskriminaciji na osnovu pola i na osnovu seksualne orijentacije.<\/p>\n<h2><strong>A \u0161ta ako se prekr\u0161e pravila o ogla\u0161avanju?<\/strong><\/h2>\n<p>Pravno lice koje prekr\u0161i pravila o ogla\u0161avanju rizikuje da bude sankcionisano kaznom od 100.000 do 1.000.000 kuna. Za fizi\u010dka lica je iznos kazne dosta manji, naime on se kre\u0107e od 10.000 do 50.000 kuna. Dakle, influenseri u Hrvatskoj definitivno mogu da budu ka\u017enjeni za \u201enepropisni\u201c influensing. Da li je ovoliki iznos sankcije dovoljan da zaustavi influensere u nepropisnom ogla\u0161avanju, ostaje da se proceni.<\/p>\n<h2><strong>A \u0161ta je sa porezom?<\/strong><\/h2>\n<p>Budu\u0107i da influenseri ostvaruju sve ve\u0107e prihode, moraju da vode ra\u010duna i o tome kakve i kolike poreske obaveze imaju. Kao i u Srbiji, i u Hrvatskoj influenseri nisu izuzeti od obaveze pla\u0107anja poreza u skladu sa <a href=\"https:\/\/www.zakon.hr\/z\/85\/Zakon-o-porezu-na-dohodak\">Zakonom o porezu na dohodak<\/a>.<\/p>\n<h2><strong>\u0160ta mo\u017eemo da zaklju\u010dimo?<\/strong><\/h2>\n<p>Pojava influensera i bavljenje influensingom je relativno novo, te je stoga i o\u010dekivano da pravnom okviru treba neko vreme da prepozna ovu kategoriju i\u00a0 njihovu delatnost. Me\u0111utim, s obzirom na porast zna\u010daja i prisustva influensinga, mogu se o\u010dekivati nova i detaljnija re\u0161enja.
