{"id":18705,"date":"2021-06-21T10:00:09","date_gmt":"2021-06-21T08:00:09","guid":{"rendered":"https:\/\/www.geciclaw.com\/?p=18705"},"modified":"2026-01-26T09:24:47","modified_gmt":"2026-01-26T08:24:47","slug":"uskladjivanje-sa-tekovinom-eu-spp-practical-law","status":"publish","type":"post","link":"https:\/\/www.geciclaw.com\/sr\/uskladjivanje-sa-tekovinom-eu-spp-practical-law\/","title":{"rendered":"Mali korak za zakonodavca ali jo\u0161 jedan korak ka uskla\u0111ivanju sa pravnom tekovinom EU"},"content":{"rendered":"<p>Vlada Republike Srbije je 11. marta 2021. godine, donela dve nove uredbe: Uredbu o uslovima i kriterijumima uskla\u0111enosti regionalne dr\u017eavne pomo\u0107i\u00a0(\u201e<strong>Uredba o regionalnoj pomo\u0107i<\/strong>\u201c) i Uredbu o pravilima i uslovima za dodelu pomo\u0107i male vrednosti (de minimis pomo\u0107i)\u00a0(\u201e<strong>Uredba o de minimis pomo\u0107i<\/strong>\u201c). Pored nedavno usvojenog novog <a href=\"https:\/\/www.paragraf.rs\/propisi\/zakon_o_kontroli_drzavne_pomoci.html\">Zakona o kontroli dr\u017eavne pomoc\u0301i<\/a>, novi propisi dodatno pro\u0161iruju pravni okvir za dodelu dr\u017eavne pomoc\u0301i. Osim toga, Komisija za kontrolu dr\u017eavne pomoc\u0301i najavila je da je u toku izrada i drugih podzakonskih akata, \u010dije se dono\u0161enje o\u010dekuje u narednom periodu.<\/p>\n<p>U skladu sa \u010dlanom 73 <a href=\"https:\/\/www.paragraf.rs\/propisi\/zakon_o_potvrdjivanju_sporazuma_o_stabilizaciji_i_pridruzivanju_izmedju_evropskih_zajednica_i_njihovih_drzava_clanica.html\">Sporazuma o stabilizaciji i pridru\u017eivanju<\/a> (\u201e<strong>SSP<\/strong>\u201c), Republika Srbija obavezala se na postepeno uskla\u0111ivanje postoje\u0107eg i budu\u0107eg zakonodavstva sa pravnom tekovinom EU. Naime, usvajanje navedenih podzakonskih akata je korak ka daljem uskla\u0111ivanju doma\u0107eg zakonodavstva sa pravnim tekovinama EU u oblasti dr\u017eavne pomo\u0107i i ka otvaranju <a href=\"https:\/\/web.archive.org\/web\/20210124123402\/https:\/\/euinfo.rs\/files\/Publikacije-srp\/35_koraka_za_web.pdf\">Pregovara\u010dkog poglavlja 8 &#8211; Politika konkurencije<\/a> i, eventualno, za ubrzavanje procesa pristupanja EU.<\/p>\n<h2><strong>Uredba o regionalnoj pomo\u0107i<\/strong><\/h2>\n<p><strong>\u00a0<\/strong>Uslovi i kriterijumi za uskla\u0111enost dodele regionalne dr\u017eavne pomoc\u0301i sa Zakonom o kontroli dr\u017eavne pomoc\u0301i do sada su bili predvi\u0111eni samo Uredbom o pravilima za dodelu dr\u017eavne pomoc\u0301i (\u201e<strong>Uredba o dr\u017eavnoj pomoc\u0301i<\/strong>\u201c). Stoga su, od 24. marta 2021. godine, stupanjem na snagu Uredbe o regionalnoj pomoc\u0301i, prestali va\u017ee \u010dlanovi Uredbe o pravilima za dodelu dr\u017eavne pomoc\u0301i koji ure\u0111uju regionalnu dr\u017eavnu pomo\u0107. Me\u0111utim, \u010dlanovi 15 i 16 Uredbe o dr\u017eavnoj pomoc\u0301i koji propisuju uslove za regionalnu dr\u017eavnu pomo\u0107 novoosnovanim malim privrednim subjektima, i \u010dlan 17 koji ure\u0111uje regionalnu pomo\u0107 za operativno poslovanje, ostali su na snazi.<\/p>\n<p>Na samom po\u010detku, prema Uredbi o regionalnoj pomoc\u0301i, pomo\u0107 se smatra uskla\u0111enom ukoliko se dodeljuje za unapre\u0111enje ekonomskog razvoja podru\u010dja sa izuzetno niskim \u017eivotnim standardom ili sa visokom stopom nezaposlenosti. Mo\u017ee se jo\u0161 dodeliti za unapre\u0111enje razvoja odre\u0111enih privrednih delatnosti ili odre\u0111enih privrednih podru\u010dja u Srbiji. Ukratko, regionalna dr\u017eavna pomo\u0107 smatra se uskla\u0111enom ukoliko se dodeljuje za ulaganje i smanjenje teku\u0107ih izdataka odre\u0111enog u\u010desnika na tr\u017ei\u0161tu koji obavlja delatnost u retko ili vrlo retko naseljenim podru\u010djima, sa izuzetkom u\u010desnika koji posluju u sektoru \u010delika, uglja, sinteti\u010dkih vlakana, saobra\u0107aja, energetike, finansijskih delatnosti, osiguranja, upravlja\u010dkih delatnosti i savetovanja.<\/p>\n<p>Treba napomenuti da je regionalna pomo\u0107, kao posebna kategorija dr\u017eavne pomoc\u0301i koja se dodeljuje za subvencionisanje privrede manje razvijenih regiona Evrope, predstavlja jedno od klju\u010dnih pitanja u pravu konkurencije EU. Naime, su\u0161tinska dilema je kako dr\u017eava mo\u017ee da subvencioni\u0161e privredni sektor ili region bez naru\u0161avanja jednakih uslova na tr\u017ei\u0161tu. Dakle, kada je re\u010d o zakonodavstvu EU, Smernice EU za regionalnu pomo\u0107 predvi\u0111aju slede\u0107e kumulativne kriterijume u skladu sa kojima se regionalna pomo\u0107 smatra uskla\u0111enom sa <a href=\"https:\/\/www.mei.gov.rs\/upload\/documents\/eu_dokumenta\/ugovor_eu.pdf\">Ugovorom o funkcionisanju Evropske unije<\/a> (\u201e<strong>TFEU<\/strong>\u201c):<\/p>\n<ol>\n<li>a) doprinos ostvarivanju cilja od zajedni\u010dkog interesa,<\/li>\n<li>b) potreba za dr\u017eavnom intervencijom,<\/li>\n<li>c) primerenost mere pomoc\u0301i,<\/li>\n<li>d) podsticajni efekat,<\/li>\n<li>e) proporcionalnost pomoc\u0301i (svedena je na minimum),<\/li>\n<li>f) pozitivni efekata na konkurenciju i trgovinu izme\u0111u dr\u017eava \u010dlanica, i<\/li>\n<li>g) transparentnost podataka o pomoc\u0301i.<\/li>\n<\/ol>\n<p><u>Suprotno tome, Uredba o regionalnoj pomoc\u0301i predvidela je samo dva od gore navedenih kriterijuma kao op\u0161ti kriterijum za sve kategorije dr\u017eavne pomoc\u0301i koja je uskla\u0111ena<\/u>. <strong>Prvi<\/strong> je <u>kriterijum transparentnosti<\/u> koji \u0107e biti ispunjen ukoliko je mogu\u0107e unapred izra\u010dunati ta\u010dan iznos bruto nov\u010dane protivvrednosti, bez potrebe za procenom rizika od prekomerne dr\u017eavne pomoc\u0301i. <strong>Drugi<\/strong> je <u>podsticajni efekat koji \u0107e biti ispunjen ako je zahtev za dodelu dr\u017eavne pomoc\u0301i podnet davaocu pre po\u010detka radova na projektu<\/u>.<\/p>\n<p>Dalje, Uredba o regionalnoj pomoc\u0301i ure\u0111uje posebne vrste regionalne pomoc\u0301i, kao \u0161to su: (i) regionalna pomo\u0107 za ulaganje i (ii) regionalna operativna pomo\u0107. Ta\u010dnije, <strong>regionalna pomo\u0107 za ulaganje<\/strong> dodeljuje se za po\u010detno ulaganje u vezi sa osnivanjem novog pravnog lica, pro\u0161irenjem postoje\u0107ih kapaciteta, diverzifikacijom postoje\u0107eg proizvodnog programa i bitnim promenama u celokupnom proizvodom procesu dok se <strong>regionalna operativna pomo\u0107<\/strong> dodeljuje za smanjenje teku\u0107ih tro\u0161kova poslovanja odre\u0111enog u\u010desnika na tr\u017ei\u0161tu koji posluje u retko naseljenim podru\u010djima. Me\u0111utim, za uskla\u0111enost regionalne pomo\u0107i za ulaganje i regionalne operativne pomo\u0107i predvi\u0111eni su odre\u0111eni kriterijumi. Naime, ovi kriterijumi uklju\u010duju opravdana ulaganja i opravdane tro\u0161kove, uslove koji se odnose na materijalnu i nematerijalnu imovinu i zarade, doprinos korisnika i veli\u010dinu preduze\u0107a.<\/p>\n<p>\u0160tavi\u0161e, Uredba o regionalnoj pomoc\u0301i predvi\u0111a dopunske kriterijume koji u potpunosti odgovaraju kriterijumima predvi\u0111enim Smernicama EU za regionalnu pomo\u0107 (npr. doprinos ostvarivanju cilja od zajedni\u010dkog interesa, potreba za dr\u017eavnom intervencijom, primerenost mere pomoc\u0301i, podsticajni efekat, proporcionalnost pomoc\u0301i, pozitivni efekti mere na konkurenciju i trgovinu izme\u0111u Srbije i zemalja \u010dlanica EU i dostupnost javnosti podataka o pomo\u0107i), ali samo izuzetno, u slede\u0107im slu\u010dajevima:<\/p>\n<ol>\n<li>a) regionalna pomo\u0107 za projekat ulaganja \u010diji iznos prema\u0161uje maksimalni iznos izra\u010dunat na osnovu Uredbe o regionalnoj pomoc\u0301i,<\/li>\n<li>b) dr\u017eavna pomo\u0107 u sektoru brodogradnje,<\/li>\n<li>c) \u0161ema pomoc\u0301i usmerena na ograni\u010deni broj posebnih sektora privredne delatnosti, ili<\/li>\n<li>d) regionalna operativna pomo\u0107 koja se dodeljuje kao dopuna regionalne pomo\u0107i za ulaganje.<\/li>\n<\/ol>\n<p>U pogledu intenziteta pomoc\u0301i, Uredba o regionalnoj pomoc\u0301i propisuje <strong><u>detaljnu metodologiju za odre\u0111ivanje maksimalnog intenziteta za opravdane tro\u0161kove ulaganja<\/u><\/strong>, kako sledi:<\/p>\n<ol>\n<li>do 50% opravdanih tro\u0161kova u podru\u010dju nivoa 2 NSTJ<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> \u010diji je BDP po stanovniku ni\u017ei ili jednak 45% proseka u EU-27;<\/li>\n<li>do 35% opravdanih tro\u0161kova u podru\u010dju nivoa 2 NSTJ<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> \u010diji je BDP po stanovniku izme\u0111u ili jednak 45% i 60% proseka u EU-27;<\/li>\n<li>do 25% opravdanih tro\u0161kova u podru\u010dju nivoa 2 NSTJ<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a> \u010diji je BDP po stanovniku iznad 60% i izme\u0111u ili jednak 75% proseka u EU-27.<\/li>\n<\/ol>\n<p>Uprkos tome, Srbija \u0107e se smatrati podru\u010djem \u010diji je BDP po stanovniku ni\u017ei ili jednak 45% proseku u EU-27 sve dok se ne izradi mapa regionalne pomoc\u0301i.<\/p>\n<p>Pored detaljne metodologije, Uredba o regionalnoj pomoc\u0301i predvi\u0111a i slo\u017eenu formulu za izra\u010dunavanje maksimalnog intenziteta pomoc\u0301i za velike projekte ulaganja, u skladu sa Smernicama EU za regionalnu pomo\u0107. Naime, formula za velike projekte ulaganja predvi\u0111a da opravdani tro\u0161kovi za po\u010detno ulaganje prelaze iznos od 50 miliona evra.<\/p>\n<p>Ne zaboravimo da Srbija, kao neto uvoznik kapitala, u trci za privla\u010denje stranih investicija pru\u017ea niz podsticaja za strane investitore. U vezi sa tim, treba naglasiti da \u0107e nova uredba sigurno imati potencijalne implikacije na politike zasnovane na podsticajima i uslove pod kojima \u0107e strani investitori mo\u0107i da apliciraju za dr\u017eavnu pomo\u0107.<\/p>\n<h2><strong>\u00a0Uredba o de minimis pomo\u0107i<\/strong><\/h2>\n<p>Uredbom o de minimis pomo\u0107i detaljnije su ure\u0111ena pravila i uslovi za dodelu de minimis pomo\u0107i, odre\u0111ivanje gornje granice iznosa de minimis pomoc\u0301i, kumulacija, kao i obaveze davalaca i korisnika takve pomoc\u0301i. Naime, de minimis pomo\u0107 jeste pomo\u0107 koja nema zna\u010dajan uticaj na naru\u0161avanje konkurencije na tr\u017ei\u0161tu i na trgovinu izme\u0111u Srbije i dr\u017eava \u010dlanica EU. \u0160to se ti\u010de <strong>gornje granice<\/strong>, de minimis pomo\u0107 mo\u017ee se dodeliti u\u010desniku na tr\u017ei\u0161tu <strong>u iznosu do 23 miliona dinara<\/strong> u bilo kom periodu u toku <strong>tri uzastopne fiskalne godine<\/strong>. Pored direktnih davanja, de minimis pomo\u0107 tako\u0111e mo\u017ee biti u obliku subvencija, subvencionisanih kamatnih stopa na zajmove, dokapitalizacije, mera rizi\u010dnog finansiranja u obliku vlasni\u010dkog kapitala, zajmova i garancija.
