{"id":21400,"date":"2022-08-12T11:02:44","date_gmt":"2022-08-12T09:02:44","guid":{"rendered":"https:\/\/geciclaw.com\/digital-markets-act\/"},"modified":"2022-08-12T12:09:32","modified_gmt":"2022-08-12T10:09:32","slug":"digital-markets-act","status":"publish","type":"post","link":"https:\/\/www.geciclaw.com\/sr\/digital-markets-act\/","title":{"rendered":"EU parlament usvojio Paket o Digitalnim Uslugama"},"content":{"rendered":"<p>Uprkos brzom tehnolo\u0161kom i poslovnom razvoju, zakoni EU o <a href=\"https:\/\/ecommerce-europe.eu\/news-item\/european-parliaments-plenary-adopts-the-digital-services-act-and-digital-markets-act\/\">e-trgovini<\/a> nisu a\u017eurirani vi\u0161e od 20 godina. Kako bi odr\u017eala korak sa ovom digitalnom evolucijom, Evropski parlament (\u201cEP\u201d) je usvojio <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/digital-services-act-package\">Zakon o digitalnim tr\u017ei\u0161tima (\u201eDMA\u201c) i Zakon o digitalnim uslugama (\u201eDSA\u201c)<\/a>. Po\u0161to je DMA usvojen u julu 2022. godine, po\u010de\u0107e da se primenjuje po\u010detkom 2023. \u0160to se ti\u010de DSA, o\u010dekuje se da \u0107e on po\u010deti da se primenjuje po\u010detkom 2024.<\/p>\n<h2><strong>Za\u0161to je usvojen DMA?<\/strong><\/h2>\n<p>Ovaj zakon ima za cilj da kontroli\u0161e uticaj najvec\u0301ih digitalnih kompanija, poznatih kao \u201e<em>gatekeepers<\/em>\u201c \u2013 u\u010desnici na tr\u017ei\u0161tu koji: a) <em>imaju zna\u010dajan uticaj na unutra\u0161nje tr\u017ei\u0161te EU<\/em>; b) <em>obezbe\u0111uju osnovnu uslugu platforme<\/em>; c) <em>u\u017eivaju ukorenjenu i trajnu poziciju u svom radu<\/em>. EU uspostavlja izri\u010dita prava i obaveze za <em>gatekeepers<\/em>, te ih tako \u010dini odgovornim za svoja dela, omoguc\u0301ava inovativnim preduzec\u0301ima i potro\u0161a\u010dima da koriste digitalne moguc\u0301nosti, i obezbe\u0111uje <strong>j<\/strong>ednake tr\u017ei\u0161ne uslove. U praksi, glavna meta DMA \u0107e biti najmoc\u0301nije svetske korporacije u IT industriji, koje se obi\u010dno nazivaju \u201eVelikom petorkom\u201c (Google, Amazon, Apple, Meta i Microsoft). DMA nastoji da spre\u010di ove kompanije da se upuste u <a href=\"https:\/\/www.concurrences.com\/en\/dictionary\/anticompetitive-practices\">antikonkurentske prakse<\/a>, kao \u0161to je zloupotreba dominantnog polo\u017eaja. Na ovaj na\u010din c\u0301e <em>gatekeepers<\/em> imati obavezu da se pona\u0161aju tako da se garantuje fer i otvoreno tr\u017ei\u0161te spremno za inovacije od strane svih.<\/p>\n<h2><strong>\u0160ta DMA zna\u010di za preduze\u0107a i potro\u0161a\u010de?<\/strong><\/h2>\n<p>Evropska komisija (EK) c\u0301e imati moguc\u0301nost da nadzire velike kompanije prilikom preuzimanja manjih preduze\u0107a. Ovo \u0107e omogu\u0107iti EK da prati razvoj tr\u017ei\u0161ta u digitalnom sektoru i da postane svesna \u201e<em>killer acquisitions<\/em>\u201c \u2013 velike korporacije koje preuzimaju nova preduzec\u0301a sa malim prihodima, ali velikim potencijalom. Jedinstven, nedvosmislen okvir na nivou EU pomoc\u0301i c\u0301e malim i srednjim preduzec\u0301ima i startrapovima da se razvijaju i budu konkurentniji.<\/p>\n<p>Na primer, prema DMA, Tehnolo\u0161ki d\u017einovi vi\u0161e ne\u0107e mo\u0107i da rangiraju svoje proizvode ili usluge iznad proizvoda i usluga drugih u\u010desnika na tr\u017ei\u0161tu (tzv. \u201esamopreferiranje\u201c koje je bila glavna tema u \u201e<a href=\"https:\/\/www.politico.eu\/article\/eu-commission-margrethe-vestager-wins-google-shopping-case\/\">Google shopping slu\u010daju<\/a>\u201c). S druge strane, potro\u0161a\u010di c\u0301e lako mo\u0107i da se odjave sa osnovnih usluga platforme, obri\u0161u aplikacije koje su nekada bile obavezne, zaustave podrazumevanu instalaciju softvera uz operativni sistem, preuzmu alternativne prodavnice aplikacija, kao i mnoge druge stvari. Tako\u0111e, <em>gatekeepers<\/em> c\u0301e morati da dozvole korporativnim korisnicima da pristupe podacima o u\u010dinku reklamiranja na odre\u0111enoj platformi, kao i da omoguc\u0301e potro\u0161a\u010dima da komuniciraju preko nekoliko razli\u010ditih aplikacija za razmenu poruka. U slu\u010daju da <em>gatekeeper<\/em> ne po\u0161tuje nova pravila DMA, EK mo\u017ee izrec\u0301i nov\u010dane kazne i do 10% godi\u0161njeg globalnog prihoda, ili \u010dak 20% u slu\u010daju ponovljenih kr\u0161enja.<\/p>\n<h2><strong>Za\u0161to \u0107e DSA biti usvojen?<\/strong><\/h2>\n<p>DSA, poznat i kao Digitalni ustav EU, predstavlja obe\u0107avaju\u0107i korak u oblasti za\u0161tite prava na internetu. Glavni cilj DSA je da korisnicima u EU obezbedi bezbednije i pouzdanije onlajn okru\u017eenje u koje \u0107e oni imati poverenja. Misija ovog zakona je da modernizuje Direktivu Evropske unije o elektronskoj trgovini iz 2000. godine, kako bi izmenila i unela nove zakonske odredbe u pogledu nezakonitog sadr\u017eaja na platformama pru\u017eaoca usluga na internetu.<\/p>\n<p>Onlajn usluge podrazumevaju \u0161iroki obuhvat digitalnih usluga koji varira \u00a0od obi\u010dnih veb stranica do velikih onlajn platformi i internet infrastrukture. DSA \u0107e se primenjivati tako \u0161to se pru\u017eaocima usluga na internetu name\u0107e obaveza du\u017ene pa\u017enje. Ova obaveza \u0107e se odnositi na provajdere internet usluga, dru\u0161tvene mre\u017ee, onlajn prodavnice, servise za razmenu poruka, dru\u0161tvene mre\u017ee, platforme za deljenje sadr\u017eaja, prodavnice aplikacija i onlajn platforme za putovanja i sme\u0161taj.<\/p>\n<h2><strong>\u0160ta DSA zna\u010di za preduze\u0107a i potro\u0161a\u010de?<\/strong><\/h2>\n<p>U narednim pasusima isti\u010demo samo neke od novih obaveza za koje se o\u010dekuje da c\u0301e uticati na preduze\u0107a i njihovo odgovorno poslovanje u onlajn sferi;<\/p>\n<ul>\n<li>DSA ograni\u010dava nezakonit sadr\u017eaj, posebno opasne i falsifikovane proizvode. Novine koje predvi\u0111a DSA \u0107e omogu\u0107iti korisnicima da prijave nezakonite onlajn sadr\u017eaje i omogu\u0107i\u0107e platformama da sara\u0111uju sa specijalizovanim \u201euzbunjiva\u010dima od poverenja\u201c kako bi otkrili i eliminisali nezakonit sadr\u017eaj;<\/li>\n<li><a href=\"https:\/\/news.bloomberglaw.com\/us-law-week\/dark-patterns-deceptive-app-design-isnt-good-for-business\">Dark patterns<\/a>, odnosno svaka obmanjuju\u0107a poslovna praksa, ciljano ogla\u0161avanje maloletnicima i korisni\u010dki interfejs dizajniran da uti\u010de na onlajn pona\u0161anje potro\u0161a\u010da su kategori\u010dki zabranjeni. Fokus je i na zahtevu za pove\u0107anjem transparentnosti algoritama koji se koriste za promociju, filtriranje ili davanje prioriteta korisni\u010dkog sadr\u017eaja;<\/li>\n<li>Ova Uredba defini\u0161e pojam veoma velikih onlajn platformi (\u201eVLOP\u201c), kao usluge koje dosti\u017eu 45 miliona aktivnih mese\u010dnih korisnika u EU (ili 10% stanovni\u0161tva EU). Za njih je predvi\u0111eno uspostavljanje obaveze nu\u0111enja usluga koje su zasnovane na profilisanju, kao i obaveza da omogu\u0107e EK i dr\u017eavama \u010dlanicama da pristupe njihovim algoritmima;<\/li>\n<li>Platforme moraju da preduzmu preventivne mere usled opasnosti kao \u0161to su manipulacije sa rezultatima politi\u010dkih izbora, \u0161irenje dezinformacija, sajber nasilje nad \u017eenama ili opasnosti za decu na internetu. Ove mere bi\u0107e predmet nezavisnih procena i moraju se pa\u017eljivo odmeriti kako ne bi kr\u0161ile <a href=\"https:\/\/ec.europa.eu\/info\/aid-development-cooperation-fundamental-rights\/your-rights-eu\/know-your-rights\/freedoms\/freedom-expression-and-information_en\">pravo slobode govora<\/a>;<\/li>\n<li>VLOP i internet pretra\u017eiva\u010di ima\u0107e obavezu da preduzmu posebne radnje u slu\u010daju velikih pretnji po javno zdravlje i bezbednosti, kao \u0161to su pandemije ili rat.<\/li>\n<\/ul>\n<p>EK \u0107e biti primarni regulator odgovoran za nadzor, istragu, sprovo\u0111enje i kontrolu VLOP-a, dok c\u0301e druge manje platforme biti pod nadzorom dr\u017eava \u010dlanica EU. Sli\u010dno svojim ovla\u0161\u0107enjima u <a href=\"https:\/\/competition-policy.ec.europa.eu\/antitrust\/procedures\/fines_en\">antimonopolskim postupcima<\/a>, EK \u0107e biti ovla\u0161\u0107ena da izrekne kazne.
