{"id":24150,"date":"2023-08-16T14:27:51","date_gmt":"2023-08-16T12:27:51","guid":{"rendered":"https:\/\/geciclaw.com\/?p=24150"},"modified":"2025-04-14T16:32:12","modified_gmt":"2025-04-14T14:32:12","slug":"intelektualna-svojina","status":"publish","type":"post","link":"https:\/\/www.geciclaw.com\/sr\/intelektualna-svojina\/","title":{"rendered":"Intelektualna svojina: Pri\u010da o evoluciji Barbie brenda"},"content":{"rendered":"<p>Od premijere filma Barbie ceo svet pri\u010da samo o njemu.\u00a0 Film je podstakao prodaju Barbie proizvoda, uklju\u010duju\u0107i \u0161minku, pribor za pisanje, napitke pa \u010dak i Barbie ku\u0107u.\u00a0 Barbie film, lutke ili brend ne bi postojali bez pa\u017eljivog pristupa za\u0161titi prava intelektualne svojine od strane kompanije Mattel.<\/p>\n<p><strong>Po\u010detak <\/strong><\/p>\n<p>Pri\u010da po\u010dinje 1956. godine kada je Ruth Handler, jedna od suosniva\u010dica kompanije Mattel Inc, tokom odmora u \u0160vajcarskoj nai\u0161la na nema\u010dku lutku po imenu Bild Lilli.\u00a0 Mattel je preuzeo Lilli lutku i napravio male izmene ove lutke, promeniv\u0161i liniju kose i obrve lutke.\u00a0 Tako je nastala Barbie lutka. Me\u0111utim, to je dovelo do tu\u017ebe vlasnika lutke Bild Lilli, koji su tvrdili da je Mattel povredio njihova prava intelektualne svojine. MCA Records, Inc) dogodio se kada je dansko-norve\u0161ki pop bend Aqua snimio pesmu &#8222;Barbie Girl&#8220;.\u00a0 Mattel je tu\u017eio bend Aqua i izdava\u010dku ku\u0107u benda, tvrde\u0107i da je bend povredio Mattel-ovo pravo \u017eiga i autorsko prava. Sudovi su na kraju odbacili ove tu\u017ebe, presudiv\u0161i da je pesma za\u0161ti\u0107ena kao parodija pod doktrinom \u017eiga nominativne upotrebe.\u00a0 Sudovi su zaklju\u010dili da &#8222;vlasnik \u017eiga nema pravo da kontroli\u0161e javnu diskusiju svaki put kada javnost njegov znak obogati zna\u010denjem izvan njegove funkcije prepoznavanja izvora&#8220;, i balansirali izme\u0111u &#8222;javnog interesa slobode izra\u017eavanja&#8220; sa &#8222;javnim interesom izbegavanja zabune potro\u0161a\u010da&#8220;, pridav\u0161i va\u017enost prvom osim ako &#8222;upotreba naziva pesme Barbie nema umetni\u010dku relevantnost za osnovno delo, ili, ako ima neku umetni\u010dku relevantnost, osim ako naslov jasno ne obmanjuje u vezi sa izvorom ili sadr\u017eajem dela&#8220;.\u00a0 Ovaj slu\u010daj se \u010duveno zavr\u0161io kada je sudija &#8222;savetovao strane da iskuliraju&#8220;.\u00a0 Ironi\u010dno, 12 godina nakon \u0161to je pesma objavljena, Mattel je kupio pravo da koristi pesmu &#8222;Barbie Girl&#8220; za reklamiranje Barbie lutaka.<\/p>\n<p>U slu\u010daju <a href=\"https:\/\/casetext.com\/case\/mattel-inc-v-walking-mountain-productions\">Mattel, Inc. v. Walking Mountain Products<\/a>, Barbie proizvo\u0111a\u010di su poku\u0161ali da spre\u010de umetnika da distribuira svoju seriju pod nazivom &#8222;Food Chain Barbie&#8220;.\u00a0 Ova serija je prikazivala Barbie zarobljenu u raznim kuhinjskim aparatima, pri \u010demu se sugeri\u0161e da Barbie u\u017eiva u tome.\u00a0 Sud je utvrdio da su ova umetni\u010dka dela dozvoljena zbog &#8222;slobodne upotrebe&#8220; jer su pravile parodiju od Barbike i poruke povezane s njom.\u00a0 Sud je tako\u0111e naveo da parodije ne moraju koristiti samo deo originalnog dela, pa je reprodukovanje cele Barbie u umetni\u010dkom delu bilo prihvatljivo.<\/p>\n<p>U slu\u010daju <a href=\"https:\/\/www.canlii.org\/en\/ca\/scc\/doc\/2006\/2006scc22\/2006scc22.html\">Mattel, Inc. v. 3894207 Canada Inc.,<\/a> Vrhovni sud Kanade je presudio da se za\u0161titni znakovi za\u0161ti\u0107uju samo za konkretne proizvode ili usluge za koje se zaista koriste.\u00a0 U ovom slu\u010daju, sud je utvrdio da je za\u0161titni znak &#8222;BARBIE&#8220; bio poznat i razli\u010dit samo za lutke i dodatke za lutke, i da nije bilo dokaza da se koristi za usluge restorana, i usluge za poneti, ketering.\u00a0 S obzirom na to da u su ovom slu\u010daju proizvodi i usluge bili razli\u010diti i prodavani na razli\u010ditim mestima, sud nije video zna\u010dajan rizik od zabune za potro\u0161a\u010de.
