{"id":46703,"date":"2025-05-29T14:16:33","date_gmt":"2025-05-29T12:16:33","guid":{"rendered":"https:\/\/www.geciclaw.com\/?p=46703"},"modified":"2025-05-29T14:23:18","modified_gmt":"2025-05-29T12:23:18","slug":"evropski-savet-cbam-reforma","status":"publish","type":"post","link":"https:\/\/www.geciclaw.com\/sr\/evropski-savet-cbam-reforma\/","title":{"rendered":"Evropski savet usaglasio pregovara\u010dku poziciju o reformi CBAM-a"},"content":{"rendered":"<p data-start=\"172\" data-end=\"313\">Evropski savet je usvojio svoju <a href=\"https:\/\/data.consilium.europa.eu\/doc\/document\/ST-9113-2025-INIT\/en\/pdf\">pregovara\u010dku poziciju<\/a> u vezi sa <a href=\"https:\/\/data.consilium.europa.eu\/doc\/document\/ST-6609-2025-INIT\/en\/pdf\">predlogom Evropske komisije za izmenu Regulative (EU) 2023\/956<\/a>, poznatije kao Mehanizam za prekograni\u010dno prilago\u0111avanje ugljenika (CBAM). Ovaj korak predstavlja zna\u010dajnu fazu u zakonodavnom postupku EU, jer Savet sada ulazi u me\u0111uinstitucionalne pregovore sa Evropskim parlamentom. Cilj reforme je pojednostavljenje CBAM okvira i smanjenje administrativnih optere\u0107enja za uvoznike\u2014posebno mala i srednja preduze\u0107a (MSP)\u2014bez ugro\u017eavanja klimatskih ciljeva.<\/p>\n<p data-start=\"841\" data-end=\"1157\">Ova inicijativa se nadovezuje na sna\u017ean politi\u010dki mandat izra\u017een u klju\u010dnim strate\u0161kim dokumentima EU, kao \u0161to su izve\u0161taji <a href=\"https:\/\/commission.europa.eu\/topics\/eu-competitiveness\/draghi-report_en\">Letta i Draghi<\/a> i <a href=\"https:\/\/www.consilium.europa.eu\/en\/press\/press-releases\/2024\/11\/08\/the-budapest-declaration\/\">Budimpe\u0161tanska deklaracija<\/a>, koji pozivaju na \u201erevoluciju pojednostavljenja\u201c u zakonodavstvu EU. Glavni elementi pregovara\u010dke pozicije Evropskog saveta prikazani su u nastavku.<\/p>\n<h3 data-start=\"1164\" data-end=\"1239\"><strong data-start=\"1164\" data-end=\"1239\">Klju\u010dna reforma: Masovni prag za izuze\u0107e po osnovu \u201ede minimis\u201c pravila<\/strong><\/h3>\n<p data-start=\"1241\" data-end=\"1463\">Su\u0161tina predloga ogleda se u uvo\u0111enju jedinstvenog kumulativnog masovnog praga za izuze\u0107e od 50 tona po uvozniku godi\u0161nje (po kalendarskoj godini), koji zamenjuje postoje\u0107a u\u017ea izuze\u0107a zasnovana na zanemarljivoj vrednosti.<\/p>\n<h4 data-start=\"1465\" data-end=\"1488\"><strong data-start=\"1465\" data-end=\"1488\">Za\u0161to je ovo va\u017eno:<\/strong><\/h4>\n<p data-start=\"1490\" data-end=\"1720\">Ovo izuze\u0107e \u0107e u potpunosti osloboditi obaveza po osnovu CBAM-a male uvoznike i prakti\u010dno sva mala i srednja preduze\u0107a, pri \u010demu se procenjuje da bi emisije obuhva\u0107ene izuze\u0107em \u010dinile svega oko 1% ukupnih emisija sadr\u017eanih u robi.<\/p>\n<p data-start=\"1722\" data-end=\"1927\">Sektori koje pokriva ovo izuze\u0107e uklju\u010duju gvo\u017e\u0111e i \u010delik, aluminijum, cement i \u0111ubriva, dok su vodonik i elektri\u010dna energija izuzeti zbog svojih specifi\u010dnih karakteristika i slo\u017eenosti u pogledu podataka.<\/p>\n<p data-start=\"1929\" data-end=\"2082\">Mera ima za cilj da drasti\u010dno smanji broj obveznika izve\u0161tavanja, pojednostavi nadzor i spre\u010di poku\u0161aje zaobila\u017eenja obaveza (npr. razdvajanje po\u0161iljki).<\/p>\n<h3 data-start=\"2089\" data-end=\"2137\"><strong data-start=\"2089\" data-end=\"2137\">Pro\u0161irena pojednostavljenja za ve\u0107e uvoznike<\/strong><\/h3>\n<p data-start=\"2139\" data-end=\"2235\">Za uvoznike koji prema\u0161uju prag od 50 tona predvi\u0111ene su dodatne procedure za pojednostavljenje:<\/p>\n<ul data-start=\"2237\" data-end=\"2777\">\n<li data-start=\"2237\" data-end=\"2341\">\n<p data-start=\"2239\" data-end=\"2341\">Ubla\u017eeni uslovi za dobijanje ovla\u0161\u0107enja za CBAM deklarante, posebno za indirektne carinske zastupnike;<\/p>\n<\/li>\n<li data-start=\"2342\" data-end=\"2419\">\n<p data-start=\"2344\" data-end=\"2419\">Mogu\u0107nost delegiranja podno\u0161enja CBAM deklaracija radi ve\u0107e fleksibilnosti;<\/p>\n<\/li>\n<li data-start=\"2420\" data-end=\"2529\">\n<p data-start=\"2422\" data-end=\"2529\">Pojednostavljeno utvr\u0111ivanje stvarnih emisija sadr\u017eanih u robi i jasnija upotreba podrazumevanih vrednosti;<\/p>\n<\/li>\n<li data-start=\"2530\" data-end=\"2680\">\n<p data-start=\"2532\" data-end=\"2680\">Standardizovani odbici za ugljeni\u010dne namete u tre\u0107im zemljama, pri \u010demu \u0107e Komisija od 2027. godine objavljivati podrazumevane cene ugljenika;<\/p>\n<\/li>\n<li data-start=\"2681\" data-end=\"2777\">\n<p data-start=\"2683\" data-end=\"2777\">Uskla\u0111eni protokoli za prikupljanje i izve\u0161tavanje podataka, koordinisani putem CBAM registra.<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"2784\" data-end=\"2829\"><strong data-start=\"2784\" data-end=\"2829\">Finansijska i uskla\u0111enost na prilago\u0111avanja<\/strong><\/h3>\n<h4 data-start=\"2831\" data-end=\"2847\"><strong data-start=\"2831\" data-end=\"2847\">Novi rokovi:<\/strong><\/h4>\n<ul data-start=\"2849\" data-end=\"3069\">\n<li data-start=\"2849\" data-end=\"2944\">\n<p data-start=\"2851\" data-end=\"2944\">CBAM sertifikati za emisije iz 2026. mora\u0107e da budu predati najkasnije do 30. septembra 2027.<\/p>\n<\/li>\n<li data-start=\"2945\" data-end=\"3069\">\n<p data-start=\"2947\" data-end=\"3069\">Obavezna zaliha sertifikata tokom godine smanjuje se sa 80% na 50% procenjenih emisija, \u010dime se osloba\u0111a kapital uvoznika.<\/p>\n<\/li>\n<\/ul>\n<h4 data-start=\"3071\" data-end=\"3120\"><strong data-start=\"3071\" data-end=\"3120\">Prilago\u0111avanja rizika u pogledu uskla\u0111enosti:<\/strong><\/h4>\n<ul data-start=\"3122\" data-end=\"3410\">\n<li data-start=\"3122\" data-end=\"3284\">\n<p data-start=\"3124\" data-end=\"3284\">Uvoznici koji prema\u0161uju prag od 50 tona bez odgovaraju\u0107eg ovla\u0161\u0107enja snosi\u0107e kazne, proporcionalne obimu emisija, s mogu\u0107no\u0161\u0107u umanjenih kazni za manja kr\u0161enja;<\/p>\n<\/li>\n<li data-start=\"3285\" data-end=\"3410\">\n<p data-start=\"3287\" data-end=\"3410\">Indirektni carinski zastupnici snosi\u0107e glavnu odgovornost ukoliko postupaju u ime uvoznika koji nije u skladu sa propisima.<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"3417\" data-end=\"3461\"><strong data-start=\"3417\" data-end=\"3461\">Tehnolo\u0161ka i institucionalna unapre\u0111enja<\/strong><\/h3>\n<p data-start=\"3463\" data-end=\"3538\">Paket za pojednostavljenje obuhvata i unapre\u0111enje digitalne infrastrukture:<\/p>\n<ul data-start=\"3540\" data-end=\"3910\">\n<li data-start=\"3540\" data-end=\"3628\">\n<p data-start=\"3542\" data-end=\"3628\">Pove\u0107an pristup CBAM registru za verifikatore i mati\u010dna preduze\u0107a stranih postrojenja;<\/p>\n<\/li>\n<li data-start=\"3629\" data-end=\"3802\">\n<p data-start=\"3631\" data-end=\"3802\">Alati za transparentnost u cilju nadzora i sprovo\u0111enja propisa, uklju\u010duju\u0107i nadzor trgovine u realnom vremenu i uskla\u0111enu komunikaciju izme\u0111u carinskih i ekolo\u0161kih organa;<\/p>\n<\/li>\n<li data-start=\"3803\" data-end=\"3910\">\n<p data-start=\"3805\" data-end=\"3910\">Mogu\u0107nost javnog objavljivanja podataka od strane operatora, ograni\u010dena samo na nepoverljive informacije.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"3912\" data-end=\"4111\">Tako\u0111e, predvi\u0111eno je da se finansiranje zajedni\u010dke centralne CBAM platforme u budu\u0107nosti obezbe\u0111uje putem naknada koje \u0107e pla\u0107ati CBAM deklaranti, \u010dime se postepeno smanjuje oslanjanje na bud\u017eet EU.<\/p>\n<h3 data-start=\"4118\" data-end=\"4155\"><strong data-start=\"4118\" data-end=\"4155\">Strate\u0161ki zna\u010daj i naredni koraci<\/strong><\/h3>\n<p data-start=\"4157\" data-end=\"4470\">Ova reforma nije samo tehni\u010dke prirode\u2014ona odra\u017eava \u0161iru politi\u010dku posve\u0107enost da se obezbedi uskla\u0111enost sa klimatskim ciljevima uz o\u010duvanje konkurentnosti. Brzo postignut konsenzus u Savetu ukazuje na nameru da se dosije finalizuje tokom 2025. godine, uo\u010di prelaska CBAM-a u svoju definitivnu fazu 2026. godine.<\/p>\n<p data-start=\"4472\" data-end=\"4701\"><a href=\"https:\/\/www.geciclaw.com\/european-parliament-cbam-simplification\/\">Evropski parlament usvojio je svoj stav<\/a> u prvom \u010ditanju 22. maja 2025, \u010dime su stvoreni uslovi za hitno zapo\u010dinjanje trijaloga.
