{"id":47875,"date":"2025-11-21T10:00:20","date_gmt":"2025-11-21T09:00:20","guid":{"rendered":"https:\/\/www.geciclaw.com\/?p=47875"},"modified":"2025-11-20T16:35:04","modified_gmt":"2025-11-20T15:35:04","slug":"eu-digital-omnibus","status":"publish","type":"post","link":"https:\/\/www.geciclaw.com\/sr\/eu-digital-omnibus\/","title":{"rendered":"EU Digital Omnibus: Pojednostavljenje digitalnog pravnog okvira Evrope"},"content":{"rendered":"<p data-start=\"0\" data-end=\"449\">Evropska komisija predstavila je <strong data-start=\"33\" data-end=\"52\">Digital Omnibus<\/strong>, zakonodavni paket osmi\u0161ljen da pojednostavi i modernizuje slo\u017eena digitalna pravila EU. Obuhvata dva va\u017ena predloga. Jedan se fokusira na racionalizaciju regulative o podacima, sajber-bezbednosti i privatnosti. Drugi precizira primenu Zakona o ve\u0161ta\u010dkoj inteligenciji (EU AI Act). Komisija o\u010dekuje da \u0107e ova reforma do 2029. doneti vi\u0161e od 4 milijarde evra u\u0161teda za kompanije, javne organe i gra\u0111ane.<\/p>\n<p data-start=\"451\" data-end=\"816\">U vezi sa AI Act-om, predvi\u0111ene su ciljane prilagodbe radi olak\u0161ane primene propisa. Time se obezbe\u0111uje da se obaveze usklade sa dostupno\u0161\u0107u tehni\u010dkih standarda. Istovremeno, klju\u010dni element paketa jeste objedinjavanje regulatornog okvira EU za podatke, pri \u010demu \u0107e se postoje\u0107i propisi spojiti u dva osnovna instrumenta: <strong data-start=\"773\" data-end=\"804\">Zakon o podacima (Data Act)<\/strong> i <strong data-start=\"807\" data-end=\"815\">GDPR<\/strong>.<\/p>\n<p data-start=\"818\" data-end=\"1095\">Digital Omnibus uvodi i jedinstveni kanal za prijavu incidenata u oblasti sajber-bezbednosti. Kori\u0161\u0107enjem pristupa \u201eprijavi jednom, podeli dalje\u201c, kompanije \u0107e mo\u0107i da ispune vi\u0161e obaveza iz NIS2, GDPR-a, DORA-e, CER-a i Uredbe o digitalnom identitetu EU putem jedne platforme.<\/p>\n<h4 data-start=\"1102\" data-end=\"1128\">Klju\u010dne izmene AI Act-a<\/h4>\n<p data-start=\"1130\" data-end=\"1772\"><strong data-start=\"1130\" data-end=\"1179\">Odlo\u017eene obaveze za visokorizi\u010dne AI sisteme:<\/strong><br data-start=\"1179\" data-end=\"1182\" \/>Jedna od najzna\u010dajnijih izmena jeste odlaganje primene pravila za visokorizi\u010dne AI sisteme u oblastima kao \u0161to su biometrija, zapo\u0161ljavanje, obrazovanje, zdravstvo, sprovo\u0111enje zakona i procena kreditne sposobnosti. Umesto od avgusta 2026., zahtevi bi se primenjivali od decembra 2027. godine za sisteme iz Aneksa III. Za sisteme iz Aneksa I primena bi po\u010dela u avgustu 2028. godine. Ipak, Komisija mo\u017ee aktivirati primenu \u0161est do dvanaest meseci ranije, ukoliko utvrdi da postoje odgovaraju\u0107i standardi i alati. Kriti\u010dari tvrde da ovaj mehanizam daje Komisiji \u0161iroku diskreciju u odre\u0111ivanju kona\u010dnog roka.<\/p>\n<p data-start=\"1774\" data-end=\"2013\"><strong data-start=\"1774\" data-end=\"1827\">Dodatno vreme za obaveze ozna\u010davanja AI sadr\u017eaja:<\/strong><br data-start=\"1827\" data-end=\"1830\" \/>Provajderi \u0107e dobiti dodatnu godinu za ispunjenje novih obaveza ozna\u010davanja AI-generisanog sadr\u017eaja, \u0161to industriji daje vi\u0161e vremena za prilago\u0111avanje tehnologije.<\/p>\n<p data-start=\"2015\" data-end=\"2237\"><strong data-start=\"2015\" data-end=\"2057\">Ja\u010da uloga Evropske kancelarije za AI:<\/strong><br data-start=\"2057\" data-end=\"2060\" \/>Omnibus pro\u0161iruje nadle\u017enosti AI Office-a, koji \u0107e nadzirati sve AI sisteme zasnovane na modelima op\u0161te namene i sprovoditi ocene uskla\u0111enosti za odre\u0111ene visokorizi\u010dne sisteme.<\/p>\n<p data-start=\"2239\" data-end=\"2469\"><strong data-start=\"2239\" data-end=\"2284\">Podr\u0161ka MSP-ovima i srednjim preduze\u0107ima:<\/strong><br data-start=\"2284\" data-end=\"2287\" \/>Olak\u0161ice u pogledu uskla\u0111enosti, koje su ranije va\u017eile samo za MSP-ove, pro\u0161iruju se i na manja srednja preduze\u0107a, smanjuju\u0107i teret dokumentacije i nadzora za \u0161iri krug organizacija.<\/p>\n<p data-start=\"2471\" data-end=\"2904\"><strong data-start=\"2471\" data-end=\"2533\">Pojednostavljeni procesi prema pravilima za\u0161tite podataka:<\/strong><br data-start=\"2533\" data-end=\"2536\" \/>Digital Omnibus poja\u0161njava kako AI razvija\u010di mogu da obra\u0111uju li\u010dne podatke, uklju\u010duju\u0107i posebne kategorije, radi otkrivanja i ispravljanja pristrasnosti, uz primenu odgovaraju\u0107ih za\u0161titnih mera. Tako\u0111e se pro\u0161iruje pristup regulatornim sandbox-ovima i mogu\u0107nostima testiranja u realnim uslovima. Planirano je uspostavljanje regulatornog sandbox-a na nivou EU od 2028. godine.<\/p>\n<h4 data-start=\"2911\" data-end=\"2935\">Klju\u010dne izmene GDPR-a<\/h4>\n<p data-start=\"2937\" data-end=\"3477\"><strong data-start=\"2937\" data-end=\"2972\">U\u017ea definicija li\u010dnih podataka:<\/strong><br data-start=\"2972\" data-end=\"2975\" \/>Predlog precizira definiciju li\u010dnih podataka fokusiranjem na to da li odre\u0111eni subjekt ima \u201erazumno verovatna\u201c sredstva da identifikuje pojedinca. Ovaj pristup po subjektu odra\u017eava noviju sudsku praksu, ali otvara prakti\u010dna pitanja: informacije koje jedan subjekt ne mo\u017ee povezati sa osobom mo\u017eda drugi mo\u017ee. U dana\u0161njim ekosistemima podataka, identifikatori poput ad ID-jeva, kola\u010di\u0107a ili otiska ure\u0111aja \u0161iroko cirkuli\u0161u. Ova promena bi zato mogla uticati na to koliko podataka ostaje u dometu GDPR-a.<\/p>\n<p data-start=\"3479\" data-end=\"3811\"><strong data-start=\"3479\" data-end=\"3514\">AI obuka kao legitimni interes:<\/strong><br data-start=\"3514\" data-end=\"3517\" \/>Predlog uvodi odredbu da razvoj i rad AI sistema ili modela predstavlja \u201elegitimni interes\u201c rukovaoca prema \u010dlanu 6(1)(f) GDPR-a. To bi obezbedilo izri\u010ditu pravnu osnovu za obradu li\u010dnih podataka u svrhe obuke AI, pod uslovom da je obrada neophodna i da ne nadja\u010dava prava i slobode pojedinaca.<\/p>\n<p data-start=\"3813\" data-end=\"4108\"><strong data-start=\"3813\" data-end=\"3847\">Jedinstvena EU pravila o DPIA:<\/strong><br data-start=\"3847\" data-end=\"3850\" \/>Predlog zahteva harmonizovane kriterijume na nivou EU za to kada je potrebno sprovesti procenu uticaja na za\u0161titu podataka (DPIA). Jedinstvene liste i \u0161abloni zamenili bi razli\u010dite nacionalne pristupe, nude\u0107i doslednost, ali umanjuju\u0107i lokalnu fleksibilnost.<\/p>\n<p data-start=\"4110\" data-end=\"4429\"><strong data-start=\"4110\" data-end=\"4162\">A\u017eurirana pravila o automatizovanom odlu\u010divanju:<\/strong><br data-start=\"4162\" data-end=\"4165\" \/>Izmene \u010dlana 22 razja\u0161njavaju da odluke neophodne za zaklju\u010denje ili izvr\u0161enje ugovora mogu biti zasnovane na automatizaciji \u010dak i kad postoji neautomatizovana alternativa. To bi moglo pro\u0161iriti upotrebu automatizovanih alata u svakodnevnim komercijalnim odnosima.<\/p>\n<p data-start=\"4431\" data-end=\"4789\"><strong data-start=\"4431\" data-end=\"4473\">Vi\u0161i prag za prijavu povreda podataka:<\/strong><br data-start=\"4473\" data-end=\"4476\" \/>Obaveza prijavljivanja povrede postojala bi samo kada je verovatan visok rizik po pojedince, ujedna\u010davaju\u0107i obavezu obave\u0161tavanja organa sa postoje\u0107om obavezom obave\u0161tavanja lica na koja se podaci odnose. Rok za prijavu produ\u017eio bi se sa 72 na 96 sati. Uspostavio bi se jedinstveni EU kanal za podno\u0161enje prijava.<\/p>\n<p data-start=\"4791\" data-end=\"5466\"><strong data-start=\"4791\" data-end=\"4839\">Promene u pravilima o kola\u010di\u0107ima i pra\u0107enju:<\/strong><br data-start=\"4839\" data-end=\"4842\" \/>Premo\u0161\u0107avanjem ePrivacy pravila u GDPR kao \u010dlan 88a, veb-lokacije bi mogle da se oslone na \u0161ire pravne osnove (uklju\u010duju\u0107i legitimni interes) umesto na saglasnost u ve\u0107ini slu\u010dajeva. Time se model pomera sa opt-in na opt-out, pri \u010demu je pra\u0107enje uklju\u010deno, osim ako se korisnik izri\u010dito ne usprotivi. Novi \u010dlan 88b uvodi standardizovane, automatizovane signale privatnosti pode\u0161ene na nivou pregleda\u010da ili sistema, koje \u0107e sajtovi morati da po\u0161tuju kada budu usvojeni odgovaraju\u0107i tehni\u010dki standardi. Odre\u0111eni medijski servisi bili bi izuzeti od obaveze po\u0161tovanja ovih signala dve godine nakon stupanja standarda na snagu.<\/p>\n<p data-start=\"5468\" data-end=\"5869\"><strong data-start=\"5468\" data-end=\"5506\">Umanjene obaveze transparentnosti:<\/strong><br data-start=\"5506\" data-end=\"5509\" \/>Rukovaoci vi\u0161e ne bi morali da dostavljaju obave\u0161tenja o privatnosti kada je razumno pretpostaviti da su pojedincima ve\u0107 poznate relevantne informacije, osim u posebnim situacijama sa pove\u0107anim rizikom. Cilj je smanjenje ponavljaju\u0107ih obave\u0161tenja, iako bi ova promena mogla zna\u010diti da \u0107e pojedinci dobijati manje direktnih informacija o obradi svojih podataka.<\/p>\n<h4 data-start=\"5876\" data-end=\"5904\">Konkuretnost ili za\u0161tita?<\/h4>\n<p data-start=\"5906\" data-end=\"6179\">Digital Omnibus te\u017ei da pozicionira Evropu kao agilnije digitalno tr\u017ei\u0161te, smanjuju\u0107i fragmentaciju i olak\u0161avaju\u0107i usagla\u0161enost. Ipak, zbirni efekat predlo\u017eenih izmena postavlja dublje pitanje: <strong data-start=\"6100\" data-end=\"6179\">dokle pojednostavljenje mo\u017ee i\u0107i kada doti\u010de same temelje za\u0161tite podataka?<\/strong><\/p>\n<p data-start=\"6181\" data-end=\"6566\">Uvo\u0111enje legitimnog interesa za razvoj AI re\u0161ilo bi dugogodi\u0161nju debatu u EU. Potvrdilo bi da se li\u010dni podaci mogu koristiti za obuku i rad AI modela. U\u017ea interpretacija osetljivih podataka ograni\u010dila bi poja\u010danu za\u0161titu na informacije koje direktno otkrivaju za\u0161ti\u0107ene karakteristike. Veliki deo dana\u0161njih bihejvioralnih i inferiranih podataka ostao bi izvan poja\u010danog re\u017eima za\u0161tite.<\/p>\n<p data-start=\"6568\" data-end=\"6998\" data-is-last-node=\"\" data-is-only-node=\"\">Digital Omnibus stoga predstavlja vi\u0161e od tehni\u010dke korekcije. On odra\u017eava \u0161ire preusmeravanje regulatornih prioriteta, upravo u trenutku kada je sposobnost izvla\u010denja osetljivih uvida iz naizgled obi\u010dnih podataka ja\u010da nego ikada. Da li \u0107e kona\u010dna ravnote\u017ea naginjati ka ekonomskoj efikasnosti ili individualnim za\u0161titama zavisi\u0107e od kona\u010dnog teksta propisa, ali i od toga kako \u0107e se novi koncepti tuma\u010diti i primenjivati u praksi.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Evropska komisija predstavila je Digital Omnibus, zakonodavni paket osmi\u0161ljen da pojednostavi i modernizuje slo\u017eena digitalna pravila EU.
