Bosnia and Herzegovina’s Arbitration Landscape: Challenges and Reforms

International arbitration in Bosnia and Herzegovina continues to develop, shaped by both domestic reforms and regional integration efforts.  Arbitration is steadily gaining recognition as a reliable alternative.  The environment remains shaped by a fragmented legal framework and limited use of local arbitral institutions.  Recent reforms aim to modernize procedures and increase international confidence.

At the same time, Bosnia and Herzegovina has seen a wave of investor-state disputes, particularly in the energy and infrastructure sectors.  These high-value cases, while costly, are also building legal capacity and highlighting the urgent need for legislative and institutional reform.

Outlook: From Exposure to Opportunity

Arbitration is expected to expand significantly in the coming years. Key drivers include EU integration, which will align local arbitration laws more closely with international standards; institutional reforms, as local arbitration centers gain traction and improve their capacity to handle complex disputes, and foreign investment growth, particularly in renewable energy, transport, and infrastructure, which will likely generate a wave of new arbitration cases.

However, challenges remain.  These include limited local expertise in handling highly technical disputes and the need for further judicial training to ensure consistent enforcement of arbitral awards.
